Product Takedowns on online platforms like Amazon looks to be on the rise in 2019. Canon is stepping up its efforts on getting new-build toner cartridges pulled off Amazon and in most cases online retailers in Europe are at the receiving end. Canon has recently been filing Report Infringement Form with Amazon based on the alleged use of claims 1 and 2 of EP ‘289 regarding the cartridge models “CB540A” and “CB542A” sold by online retailers. Amazon in turn is taking down these products.

Platforms like Amazon have perceived more risks and liability when the cases lean on them about infringing online resale. Filing a Report Infringement Form with Amazon is a service offered by Amazon and does not comprise any official finding of validity or infringement of a patent. The decision to take down a product is in the discretion of Amazon and is based on information provided by OEMs. Obviously reports of potential infringement or inauthentic items prompts an internal investigation and resellers will go through a hard time providing the kinds of information Amazon asks for. The increase in number of filings regarding product listings which allegedly infringe patent are making it harsher than ever for online retailers. But does that mean retailers can do nothing and only suffer in this challenging environment?
